Terms and Conditions

This is a legally valid agreement that lays out the terms and conditions for the use of all services which comes under VA Networks’s services agreed by you. The usage of the service is limited under all the terms & conditions herewith published. This agreement shall be governed by the rules and regulations of the authorities of the Government of India.

Please read this agreement carefully. All notices under this agreement will be considered as written and have been duly signed once the same is electronically confirmed.

Service Usage Policy

You agree to abide by all applicable local, national and international laws and regulations. You are solely responsible for all acts or omissions that occur under your account, including the content of the messages transmitted through the service.

The SMS service that sends/receives messages to/from mobile phones is maintained by VA Networks. The utilization of the SMS service is subject to the following Terms and Conditions:

• Any illegal use of the SMS service is strictly prohibited.
• Messages containing sexual, racist or discriminatory content may be considered harassment and you are solely responsible.
• VA Networks does not assume any liability for the content of messages sent.
• VA Networks will be exempted from any claim arising from third parties as a result of message content.
• You guarantee that SMS content respects fundamental human rights and Intellectual Property laws.

You agree not to use the service to:

• Promote alcohol, music, dancing, dating, gambling or deception.
• Send unsolicited messages (mobile spam).
• Collect information about others without consent.
• Mislead recipients regarding the sender identity.
• Transmit unlawful, abusive, vulgar, obscene or harmful content.
• Transmit content that infringes intellectual property rights.
• Transmit viruses, trojans, worms or harmful software.
• Attempt unauthorized access to systems or networks.
• Interfere with other users’ use of the service.
• Engage in activities that may expose VA Networks to legal liability.

You acknowledge that VA Networks delivers SMS messages via telecom operators and delivery depends on the recipient’s mobile network provider and device status.

You are responsible for the privacy and storage of your username and password. All activities under your account are legally binding on you.

VA Networks does not guarantee availability or performance of the service and accepts no liability for delays or failures in transmission.

No refund will be provided for undeliverable SMS messages. All purchases are final and subject to our no-refund policy.

SMS account balances are non-refundable and do not bear interest. Credits must be used within the validity period.

You shall indemnify and reimburse VA Networks for all liabilities, losses and damages resulting from third-party claims caused by your breach of contract.

By registering, you agree to receive promotional SMS, RCS messages, Google messages, emails and voice calls from VA Networks or CPaaS Studio.

Credit

The number of credits may be recalculated based on changes in SMS costs imposed by telecom operators. Credit types and values may be modified, deleted or added at the sole discretion of CPaaS Studio.

Limitation of Liability

While we take reasonable steps to deliver your messages promptly, we cannot guarantee delivery times. Delivery depends on network and system-related factors.

Delivery reports and sender ID availability depend on operator support and cannot be guaranteed.

VA Networks is not responsible for final delivery of messages, as this is controlled by the Mobile Network Operator.

We are not liable for any financial or other loss arising from delivery failure. Message contents are deemed to have zero value.

SMS messages are transmitted unencrypted, and interception by third parties is possible. Sensitive information should be communicated using multiple methods.

The service is provided “as is” and “as available” without warranties of any kind.

We disclaim all warranties regarding accuracy, completeness, merchantability or fitness for a particular purpose.

Modification of Terms

We may update, modify or improve the service and related terms at any time as reasonably necessary.

You are responsible for reviewing these terms periodically and staying informed of changes.

If there is a conflict between specific terms and these general terms, the specific terms will apply.

Termination

If you breach these terms, we may suspend, terminate or cancel your account and recover damages where applicable.

Suspension does not remove your responsibility for obligations already accrued, including payment obligations.

You may terminate this agreement at any time by notifying us in writing via email. However, you remain responsible for obligations incurred during your usage period.

Our terms and conditions are subject to change according to TRAI/DOT rules and regulations.
